REAL ESTATE LITIGATION

Bogorad & Richards has decades of experience representing all sides of complex real estate disputes in the Washington D.C. metropolitan area. 

We have (i) represented both buyers and sellers in disputes arising out of purchase and sale agreements, including lawsuits seeking both specific performance and damages, (ii) represented both owners and tenants in commercial landlord tenant disputes, (iii) represented owners in real estate disputes with the federal government, including eminent domain and inverse condemnation litigation, (iv) defended against and prosecuted claims for commercial real estate brokerage commissions, and (v) represented owners and developers in land use disputes with neighboring land owners.

Bogorad & Richards has also represented both lenders and borrowers in disputes arising out of loans secured by commercial real estate. We have represented banks, insurance companies, pension funds and other institutional lenders in enforcement of their rights under mortgages and deeds of trust, under state law and in bankruptcy courts, in all three local jurisdictions.

BANKRUPTCY LITIGATION

Bogorad and Richards is available to represent secured and unsecured lenders, commercial landlords, equipment lessors and other creditors and interested parties in adversarial bankruptcy cases.

PARTNERSHIP & SHAREHOLDER DISPUTES

Bogorad & Richards has many years of experience representing owners and investors with respect to internal governance disputes in a wide range of business areas, including real estate, energy and technology. We have prosecuted and defended claims between equity and other stake holders for accounting, breach of fiduciary duty, fraud, breach of contract, and embezzlement.  Additionally, we have brought and defended against derivative actions and have defended against dissolution actions filed by disgruntled minority equity holders.

Bogorad & Richards has handled a variety cases that have raised novel and untested questions of insurance coverage in matters of general liability policies, title insurance, aviation insurance, professional liability insurance, and corporate fidelity policies.

EMPLOYMENT & TRADE SECRET LITIGATION

Bogorad & Richards has handled employment disputes from both sides of the employer and employee relationship in matters involving trade secrets, covenants not to compete, commercial torts, alleged ERISA violations, wrongful termination, sexual harassment and discrimination claims, and class action claims brought under the Fair Labor Standards Act. Our experience includes handling the emergency motions for injunctions that often accompany suits in this field.

COMMERCIAL DISPUTES

Bogorad & Richards has years of experience in the litigation of commercial claims that stem from a variety of contract disputes and claims of wrongful or allegedly wrongful actions by businesses and individuals.
